These Terms of Service ("Terms") govern your access to and use of the GoJumba mobile application and backend services (collectively, the "Service"), provided by GoJumba: AI Receptionist ("GoJumba", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
If you don't agree to these Terms, don't use the Service.
GoJumba provides an AI-powered phone receptionist that answers calls to phone numbers you provision through us, takes messages, books appointments, transfers calls, and sends you notifications. The Service is intended for businesses and is not designed for personal, non-commercial use.
You must provide accurate information at signup and keep it up to date. You are responsible for safeguarding your password and for all activity under your account. Notify us promptly at privacy@gojumba.com if you suspect unauthorized access.

We may suspend or terminate your account for violations, with or without notice depending on severity.
The Service records and processes inbound calls in real time using AI. You are solely responsible for compliance with call recording and consent laws in the jurisdictions where you and your callers are located. Some U.S. states (including California, Florida, Illinois, Massachusetts, Maryland, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, and Washington) require consent from all parties to record a call. The AI's greeting can be configured to include a recording disclosure — it is your responsibility to enable it where required.
Our IP. GoJumba and the Service (including software, design, branding, AI prompts, and underlying algorithms) are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
Your content. Configuration you provide (business name, hours, FAQs, transfer numbers, etc.), call recordings, transcripts, messages, and appointment data ("Customer Data") remain yours. You grant us a limited license to host, process, and display Customer Data as necessary to provide the Service.
Feedback. If you send us feedback or suggestions, we may use them without obligation to you.
The Service uses AI models that may produce inaccurate, incomplete, or unexpected output. We do not guarantee that the AI will correctly understand callers, accurately capture information, book appointments without errors, or behave consistently. You are responsible for reviewing AI-captured messages and appointments before relying on them for business decisions.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation.
You can terminate your account anytime by canceling your subscription and emailing us to request data deletion. We may suspend or terminate your account if you violate these Terms, fail to pay, or for any other reason at our discretion with reasonable notice. On termination, your right to use the Service ends immediately and we may delete your data per our Privacy Policy retention schedule.
To the maximum extent permitted by law, GoJumba and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.
Some jurisdictions don't allow exclusion of certain warranties or limitation of liability — in those, our liability is limited to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless GoJumba and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your use or misuse of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right (including call recording consent laws), or (d) any content or instructions you provide through the Service.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles.
Arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in Missouri, or another mutually agreed location, and will be conducted in English. Judgment on the award may be entered in any court with jurisdiction.
Class action waiver. You and we each agree to bring claims only in your or our individual capacity and not as a plaintiff or class member in any class, collective, or representative action.
Exception. Either party may bring a small-claims court action on an individual basis instead of arbitration, and either party may seek injunctive relief in court for misuse of intellectual property or unauthorized access to the Service.
We may revise these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
